This
certifies that _______________________________________, herein referred to as
mare owner, has engaged one service to Coosa_________________________________________________
for the mare ___________________________________________,
Reg.
No. ____________________ for the 2007 breeding season at $1,500 live foal guarantee.
Rosewood Ranch, agent for the
above named stallion, will herein be referred to as Breeder.
This service is subject to the
following:
1.
This contract is good for
one foal. Multiple foals from the same
mare in the same breeding season will require a separate contract and breeding
fee for each resulting foal. The only
exception to this would be twins that are carried throughout term and foaled by
one mare.
2.
A non-refundable booking
fee of $500 of the above breeding fee is payable with this contract. The balance of $1,000 plus all
unpaid expenses will be payable upon receipt of an invoice. All fees and costs must be paid before any
semen will be shipped, unless other arrangements have been made and agreed upon
between Mare Owner and Breeder. Payment
of shipping and courier fees may be subject to change without notice.
3.
The current shipping fee
of $275.00 includes the following
services:

Handling fee (collecting,
preparing, and packing semen)
·
Courier to airport
·
Federal Express
·
Equine Express II
Disposable Container
SPECIAL PROMOTION: The first $275.00 shipping fee will be waived
for the 2007 season.
4.
After invoice has been
sent, 1.5% interest will be charged on all accounts in excess of thirty days.
5.
A photocopy of
registration papers (both sides) shall be sent to the Breeder with this
contract.
6.
Typical collection days
will be Monday, Wednesday, and Friday, but other arrangements may possibly be
made on special request.
7.
Semen will typically be
collected on Mondays, Wednesdays, and Fridays, and shipped on the same day or
the next. Alternate arrangements may
possibly be made by special request.
8.
All semen orders must be
received by 3:00 p.m. CST the day before the requested collection date. Late orders are not guaranteed
9.
Semen orders will be
filled in this order of priority:
·
All mares on premises of
Rosewood Ranch will be serviced first.
·
If there is sufficient semen
to fill all orders of a given day, the farm veterinarian will determine which
orders will be honored. This decision
will be based on the information provided by the purchaser’s veterinarian.
·
Rosewood Ranch requires
that you notify the breeding manager when the mare first shows signs of heat.
·
Rosewood Ranch also
requires notification by the purchaser’s veterinarian to Rosewood Ranch the day
before the desired collection.
10. Semen shall be provided only to healthy mares in sound
breeding condition as determined by a veterinarian.
11.
In the event the mare is
barren, open, or not a maiden, Rosewood Ranch may require the submission of a
recent negative intrauterine culture and biopsy.
12.
In all cases, the
veterinarian must certify that the mare’s immunizations for equine
rhinopneumonitis (Equine Herpes Type 1) have been kept current.
13. All mares are required to be examined by a licensed
veterinarian by palpation and if possible also ultrasound.
14.
Purchaser agrees to have
the mare examined for pregnancy by ultrasound and submit such results along
with insemination and conception reports to Rosewood Ranch within 14 days after
ovulation of that cycle. In the event
the mare is barren, Rosewood Ranch may require the submission of a negative
intrauterine culture and/or biopsy and/or progesterone assay.
15.
Purchaser agrees to have
mare examined for pregnancy by veterinarian at 28 days post ovulation and again
at 60 days.
16.
Purchaser agrees that
chilled semen requires special handling and that attempts to breed any mare
outside controlled conditions of an equine reproductive center can greatly
reduce, and in some cases prevent, chances of conception.
17.
Purchaser agrees to
return all insemination certificates to the Breeding Manager within 30 days of
insemination. Failure to comply could inhibit
registration of resulting foal.
18.
The purchaser is entitled
to 2 semen shipments per estrus cycle, for no more than 3 cycles per breeding
season.
19.
Live Foal Guarantee. Live foal means the foal shall stand and
nurse. It is understood that if the
mare proves barren, aborts her foal, or if the foal is stillborn, A RETURN
SEASON WILL BE GUARANTEED THE FOLLOWING YEAR ONLY, providing proper
notification is given. Proper
notification shall be defined as follows:
Written certification by a licensed veterinarian within seven days that
the mare has slipped or produced a non-viable foal. Mare Owner certifies that such abortion or death did not result
from any act or omission of the Owner subsequent to the mare’s insemination.
20.
The breeding season in
force for this contract shall begin February 1st and close July 1st
of the year covered by this contract.
21.
It is further agreed that
should the above named stallion die, or become unfit for service, or, if the
above named mare dies during the breeding season, then the Mare Owner my
substitute another mare or breed the above named mare to another stallion on
the farm that is agreed to by both the Mare Owner and Breeder.
22.
A breeder’s certificate
will be issued to Mare Owner after all expenses have been paid in full and upon
notification of the birth of the foal.
23.
The booking fee is not
refundable.
24.
Liability: Rosewood Ranch is not responsible for lost,
delayed, or damaged semen and makes no representatives or warranties of any
kind with respect to semen except that it is the stallion’s and is viable semen
at time of shipment.
25.
This contract cannot be
assigned or transferred by purchaser.
26.
Payment methods: Cash, check, cashiers check, or money order.
27.
When the above named Mare
Owner signs and returns one copy of this contract to the Breeder it will then
be a binding contract on both parties subject to the above terms and
conditions. This contract is not valid
unless completed in full.
